Resumo: The environment, guaranteed in the brazilian Constitution of 1988 as a fundamental right, has a broad definition, that, beyond the mere reference to nature, contemplating life in all its forms and expressions. In this broad understanding, ecologically balanced environment and essential to a healthy quality of life shall be guaranteed not only for present generations and also for those who has to come. This guarantee for future generations is an expression of the principle of intergenerational equity that inspires but an environmental state, at least a greening democratic state.
