The Objective Dimension of Fundamental Rights and the Role of Independent Regulatory Agencies

Resumo: The objective dimension of fundamental rights is related to the goals of the society, collectivity, which binds to the Public Power. Since the State reform, the independent regulatory agencies play an important role on the national scene acting in the regulation of public services, monopolies and essential economic activities. The potential of Brazilian regulatory agencies for the promotion and protection of fundamental rights aimed at the goals of the collectivity are vast. Their actions may have higher or lower reflections, both in positive and negative aspects concerning to fundamental rights. The challenge for the agencies is to exercise their regulator functions bearing in mind the objective effects of fundamental rights.

O potencial das agências reguladoras brasileiras de promoção e proteção dos direitos fundamentais voltados aos objetivos da coletividade é vastíssimo. Seus atos podem ter reflexos maiores ou menores, tanto no aspecto positivo como negativo em relação a direitos fundamentais.
