Resumo: Analyzes the current form of legal phenomenology applied to civil torts, with the expansion of its classical categories to other modalities previously ignored. It presents short historical development of the subjective right, until it will achieve the concept of legal interest. Discusses the new forms of legal phenomenon - existential legal situation and the existential legal business - and the way in which, therefore, allowed to speak, these days, in existential damage that transcend the classical notion of moral damage.
