The Current Role of Constitutional Interpretation as a Guide to the Law Enforcement

Resumo: Starting from the constitutional state, founded on the supremacy of the rule and popular sovereignty, the present article analyzes the importance of the interpretive exercise on contemporary society performed by people and the law operator. Presenting meanings that were adopted to the Constitution even as the extension of constitutional norms differentiates principles, rules and exposes classic constitutional interpretation methods, noticing the new paradigms presented on the conflicts of the “information society” that is constantly changing. Using the inductive method procedure under qualitative bibliographic approach concludes that current interpretive leadership ended up reinforcing the phenomenon of the justiciability and judicial activism.

Apresentando os sentidos adotados para a Constituição, bem como a abrangência das normas constitucionais, diferencia princípios e regras e expõe os métodos clássicos de interpretação constitucional, apontando novos paradigmas presentes nos conflitos da sociedade da informação em constante mutação.
