Juridicity of Constitutional Norms and Classificatory Deconstruction

Resumo: This article proposes to analyze the juridicity of constitutional norms and their interpretive scope disassociated from purely syntactic-semantic classification. The failure in stereotyping the constitucional norms comes from an understanding of Law as an integrated whole that acquires sense only in a hermeneutic framework of interpretation, understanding and application, which is attainable only in the face of a concrete case. The possible problem of judicial activism as a barrier to this understanding, as will be verified, can be settled by the exhaustive substantiation of the decisions in compliance to due legal process, equality of arms, and effective defence.
