Resumo: This assay reconstructive research methodology asks how the interaction between democracy, human rights, justice and global imperatives is disposed at the thought of Habermas. Its objective is the rational explanation of its internal connections. Exposes like Habermas, from the public sphere reconstruction and communicative action addresses the justice and law. The dialectic between facticity and validity, interweaves philosophy and sociology to develop its normative approach to law and the state, connecting law and democracy through the discursive paradigm of law. Connects constitutional jurisdiction, law,politics, civil society and the public sphere.
