Doctrinal Bases Toward a Decent Work Right

Resumo: The promotion and development of decent work are International Labour Organizations (ILO) goals which are highlighted by the ILO Declaration on Social Justice for a Fair Globalization. They are also goals of the Brazilian system of social fundamental rights. This article discusses the decent work agenda of the ILO and try to explain the social and legal context of the four current principles of decent work. The rights considered basic to a decent work, according to international human rights are addressed. The method of approach is analytical and comparative. The research sources are, mainly, recent reports issued by the International Labour Organization. The article argues the category of rights that can be classified as specific rights of decent work is the basic human rights set forth in the International Charter on Human. These regulations and documentary bases are enough parameters to develop a legal doctrine of minimum meaning for decent work guided by a human rights based approach.

These regulations and documentary bases are enough parameters to develop a legal doctrine of minimum meaning for decent work guided by a human rights based approach.A  promoção  e  desenvolvimento  do  trabalho  decente  são  objetivos  da  Organização Internacional do Trabalho, destacados na Declaração da OIT sobre a Justiça Social para uma Globalização  Equitativa.  Também  são  objetivos  do  sistema  brasileiro  de  direitos fundamentais sociais. Este artigo aborda a agenda do trabalho decente da OIT e procura explicar o contexto social e normativo dos quatro princípios atuais do trabalho decente. São abordados os direitos considerados básicos para uma concepção de trabalho decente, segundo o sistema internacional de direitos humanos do trabalho. O método de abordagem é analítico e comparativo.
