THE CRISIS OF JURISDICTION AND THE FUNCTIONALIZATION OF THE LAW BY THE ECONOMY: THE JUSTICE AND THE NUMBERS

Resumo: The jurisdiction is in a deep crisis, of multiple facets and in a scenario of globalization, among which one can visualize the functionalization of law by other areas, such as economics. In view of this situation, the present article start from the following problem: in what measure does the economist speech affect the crisis of jurisdiction? Thus, the work proposes to investigate the functionalization of law as one of the factors of the crisis of jurisdiction, using the hermeneutic phenomenology of Heideggerian-Gadamerian matrix as a research path, along with the functional procedure method and the techniques of bibliographic review and documentary. In order to do so, the objective is to investigate possible brands of the functionalization of law by the economy in the Report of Justice in Numbers of 2017. In this context, the study finds justification in the need to (un)veiling the Brazilian society in crisis, considering a scenario of globalization and hyperjudicialization, and also in the imperative to think of the autonomy of law as a north, a possible meaning in the face of a chaotic crisis.

Tendo em vista essa constatação, o presente ensaio parte do seguinte problema: em que medida o discurso economicista impacta a jurisdição e acirra a(s) sua(s) crise(s)? Assim, o trabalho se propõe a investigar a funcionalização do direito como um dos fatores da crise da jurisdição, valendo-se da fenomenologia hermenêutica de matriz heideggeriana-gadameriana como caminho de pesquisa, juntamente com o método de procedimento funcional e as técnicas de revisão bibliográfica e documental. Para tanto, objetiva-se investigar possíveis marcas da funcionalização do direito pela economia no Relatório Justiça em Números 2017 (ano-base 2016).
