Legal Education in the Perspective of Fighting Youth Rights Recognition in Brazil : The Other Place in Learning

Resumo: The article has the objective of making a review of the legal education in the perspec- tive of  the young people’s rights and a struggle for recognizing of these rights, emphasi- zing  their  learning  process and their possibilities of emancipation. The analysis unfolds in three aspects: the reconstruction of the role of the university and its legal education;  the connection to the students  life style and their subjectivity construction processes; and  it examines the struggle on recognizing  their rights based on Axel Honneth’s thought, which relates  teaching and learning.  Finally, the analysis draws the attention to  the emancipation of perspectives on legal education and the rights of young people,  in Brazi- lian’s reality.  The analysis presumes to identify paradoxes and blockages of the emancipa- tion of young people in legal education,  while  supportes the premise that it is  possible  to achieve  the rights of young people  as well as all people in society through teaching and learning in law higher education.

Servindo-se de um aporte crítico, a análise se desdobra em três principais aspectos: inicia-se com a reconstrução do papel da universidade e do ensino jurídico; em segundo lugar, preocupa-se em estabelecer uma conexão com o estilo de vida dos jovens estudantes no Brasil e os processos de construção da sua subjetividade e, em terceiro, examina-se a configuração de uma luta por reconhecimento de direitos, baseado no pensamento de Axel Honneth, relacionada ao ensino e à aprendizagem. No final, a análise se volta para as perspectivas de emancipação do ensino jurídico e a efetivação dos direitos dos jovens na realidade brasileira.
