Resumo: This study approaches the practice of planned obsolescence inserted into contemporary society. Humanity is dependent on natural resources, which meet the demand of the consumerist market, ignoring sustainability and the ethics of consumption embedded into the purposeful logic of the short cycle of products. As a result, the intention is to demonstrate the way in which planned obsolescence is one of the obstacles to an ecologically balanced environment as a fundamental right guaranteed by the Constitution in force. On that purpose, the research method was the theoretical and legal one with deductive reasoning and bibliographical and document research technique.

Como resultado, pretende-se demonstrar o modo pelo qual a obsolescência programada é um dos óbices para o meio ambiente ecologicamente equilibrado, enquanto direito fundamental assegurado pela Constituição vigente.
