Resumo: This article intends to analyze how the changes in the Technological Innovation Act affected exclusivity clauses in these agreements. The main target is to evaluate the presence of exclusivity clauses in contracts of technological cooperation. Methodologically, the institutional microanalysis, based on the idea of law as identity, is used as a methodological tool to evaluate the Technological Innovation Act so as to critically reconstruct the objectives of the transfer of technology from public to private agents, granted by the Act, regarding the values of a personified community in a context of public-oriented actions.
