Resumo: The effects of the Cold War, globalization and technology affect cultural, political and economic countries. The concept of morality has changed place. Behind the law is the economic morality. Nanotechnologies will be addressed under this bias. Can the Law and Economics be applied? It is with the theories of Alexy and Posner and the transposition of the historical moral to economic, that this analyse is confirmed as hypothesis for nanotechnologies. For the realization of the research it will be used the systemic-constructivist method and the technique will be data collection and interdisciplinary literature review.
