Resumo: The present text aims to analyze the distinctions and similarities between the legal regimes of private legal assistance (lawyers) and public legal assistance (Public Defender's Office) in the current framework, which includes the legal context, the most recent decisions of higher courts, and doctrine on the subject. It is sought to point out that private - lawyers - and public defense – public defenders - are not the same, however, their legal regimes interact in some points. The study was carried out through a bibliographic review and analysis of judicial decisions.

Procura-se apontar que advocacia e defensoria não se confundem, contudo, seus regimes jurídicos interagem em alguns pontos.
