This article seeks to identify the legal norms that ensure the right of adoption by homosexual couples in Brazil, considering the existing legislative gap. The methodology employed in this article is primarily bibliographic, drawing upon theories, legislation, bills, and previously published articles. The research examines the Brazilian Constitution of 1988 and the Statute of the Child and Adolescent to identify legal values that both influence and are influenced by the protection of rights. Various perspectives will be addressed, focusing on the legislative gap surrounding homoaffective couples, alongside the elucidation of constitutional principles that may impact homoaffective adoption. The objective is to distance the analysis from prejudices and religious biases, which contradict the guarantee of fundamental rights for marginalized groups. Through this study, it becomes evident that affection plays a more significant role in the pursuit of well-being for institutionalized children and adolescents than adhering to a traditional, heteronormative family structure. This fact further reinforces the rights of homoaffective couples in relation to adoption.
