Internet and information as fundamental rights that condition access to justice in the digital environment

Resumo: This research aims to study the reasons why the consolidation of access to justice in the digital environment may depend both on access to the Internet and access to information. Using the hypothetical deductive approach and the bibliographical research technique, it analyzes the convergent and problematic aspects of the interdependence between access to justice and the Fundamental Rights of access to the Internet and to information from the procedural guarantees and access to technological support, especially to people who are vulnerable due to their personal characteristics and circumstances. It is concluded that access to the Internet makes it possible that, in moments like the pandemic, individuals continue to have access to some of their rights, especially through the adequate treatment of legal information in a clear and easy-to-understand language.

Utilizzando l'approccio ipotetico deduttivo e la tecnica di ricerca bibliografica, analizza gli aspetti convergenti e problematici dell'interdipendenza tra l'accesso alla giustizia e i diritti fondamentali di accesso a Internet e all'informazione a partire dalle garanzie procedurali e l'accesso al supporto tecnologico, soprattutto per le persone vulnerabili a causa delle loro caratteristiche e circostanze personali.
