Summary: The aim of this article is, based on the Human Rights of Patients reference and the position of the European Court of Human Rights, to problematize the use of the rights to life and privacy in blood transfusion of Jehovah's Witnesses patients, through the analysis of decisions handed down by Brazilian Judicial Courts. Methodologically, it was carried out a study of the literature on HRP, the analysis of decisions made by the European Court and the Brazilian jurisprudence on the subject. It has been concluded that HRP are adequate to support court decisions in cases involving Jehovah's Witness patients and the request for a forced blood transfusion.

Metodologicamente, realizou-se estudo da literatura sobre os DHP e foi feita análise de decisões proferidas pela Corte Europeia e da jurisprudência brasileira sobre o tema.
