Brief comments about the mediation institute

Resumo: This work aims to briefly discuss the mediation institute as an instrument for consensual conflict resolution. As a methodological beacon, a bibliographic review was used through qualitative research. Thus, the corpus was constituted by the analysis of current Brazilian legislation, doctrine, and other alternative biographical sources. As a result, it was identified that the conflict is present in the most diverse social spaces, performing different functions. Nowadays, in view of the large accumulation of lawsuits, the search for new forms of conflict resolution has been presented in the current legal system as an alternative means to relieve the judiciary and encourage new legal and social practices. It was observed that, even in view of the incorporation of information and communication technologies for online mediation practices some indoctrinators have made important criticisms of the institute under study. Since it lacks public policies that allow subjects involved in a legal relationship to equal postulancy in order to remove possible legal and social imbalances.

Since it lacks public policies that allow subjects involved in a legal relationship to equal postulancy in order to remove possible legal and social imbalances.     O presente trabalho objetiva discutir, brevemente, o instituto da mediação enquanto instrumento de resolução consensual de conflitos. Como baliza metodológica, recorreu-se à revisão bibliográfica, através de uma pesquisa qualitativa. Assim, o corpus foi constituído da análise de legislação brasileira vigente, doutrina, bem como fontes bibliográficas. Como resultado, identificou-se que o conflito está presente nos diversos espaços sociais, desempenhando diferentes funções. Na atualidade, em face ao grande acúmulo de processos judiciais, a busca por novas formas de resolução de conflito tem se apresentado no ordenamento jurídico vigente enquanto um meio alternativo possível para desafogar o judiciário e incentivar novas práticas jurídico-sociais.
