Resumo: This paper has the purpose to present the state of the art of integral and free legal aid in Brazil, based on the analysis of the Public Defender’s Office role in the realization of the fundamental rights of the needy. To this end, first, the concept of access to justice will be delimited, as well as the main obstacles to its implementation and some practical solutions inserted in the “renewal waves” initially proposed by Mauro Cappelletti and Bryant Garth. Subsequently, will be discussed the historical evolution of the legal instruments guaranteeing free access to justice in Brazil, culminating with the constitutionalization of the legal aid service subsidized by the State, which provides the Public Defender’s Office as the institution responsible for its implementation. Next, the manner in which the Public Defender’s Office has consolidated itself as an autonomous institution with avant-garde institutional functions will be discussed, ending with a reflection on how its normative and practical revolution has opened new perspectives for the institution.

Para ello, en primer lugar, se debatirá el concepto de acceso a la justicia, los principales obstáculos para su realización, así como algunas soluciones prácticas incluidas en las "olas renovatorias" propuestas inicialmente por Mauro Cappelletti y Bryant Garth. Posteriormente, se debatirá la evolución histórica de los instrumentos jurídicos que garantizan el acceso a la justicia gratuita en el ámbito brasileño, culminando con la constitucionalización del modelo actual, que prevé la Defensa Pública como la institución responsable de su realización. A continuación, se abordará la manera en que la Defensa Pública se consolidó como institución autónoma, con funciones institucionales de vanguardia, finalizando con una reflexión sobre cómo su revolución normativa y práctica ha abierto nuevas perspectivas de actuación.O presente artigo tem como objetivo apresentar o estado da arte da assistência jurídica integral e gratuita no Brasil, a partir da análise do papel da Defensoria Pública na efetivação dos direitos fundamentais dos mais necessitados. Para tanto, primeiramente, sera? debatido o conceito de acesso à justiça, quais os principais obstáculos à sua realização, além de algumas soluções práticas inseridas nas “ondas renovatórias” propostas inicialmente por Mauro Cappelletti e Bryant Garth. Posteriormente, discutir-se-á a evolução histórica dos instrumentos jurídicos garantidores do acesso à justiça gratuito no âmbito brasileiro, culminando com a constitucionalização do atual modelo, que prevê a Defensoria Pública como a instituição responsável pela sua concretização.
