Resumo: Since health is the right of all and the duty of the State, which can be enforced by thecourts, including the provision of medicines for medical treatment not offered by theState through the SUS, either due to the lack of a protocol for the distribution or due to the lack of the medicine in the stock, this study aims to verify if it is possible to talkabout the effectiveness of emergency tutelage granted in lawsuits pleading for drugsin the judicial subsection of Caruaru, state of Pernambuco, Brazil, by analyzing someactions proposed by the Public Defender of the Union in Caruaru between the yearsfrom 2018 to 2020. For this purpose, the study was conducted using the deductivemethod, based on the premise that there is ineffectiveness of emergency tutelage inthe aforementioned Subsection, considering the time to materialize, and analyzed,by quali-quantitative research, ten actions that plead for the supply of medicine with arequest for urgent guardianship, in which the time was observed between the grantingof the request and the effective availability of medicines, and the complications in theprocedure that influenced the fulfillment of the measure. After analyzing the data,the initial premise was not confirmed, and the study concluded that the average timebetween the preliminary injunction and the effective use of the medication is inherentto internal “bureaucratic” steps, and cannot establish an ideal average term, beingpossible, however, to minimize that time

Para este propósito, el trabajo, por el método deductivo, comenzó desde la premisa de que la tutela de emergencia es ineficaz en la subsección antes mencionada, considerando el tiempo que aparentemente lleva materializarse y analizarse, a través de una investigación mixta ( cuantitativo), diez acciones que abogan por el suministro de medicamentos con solicitud de urgencia diferida, en el que se observó el tiempo entre el otorgamiento de la solicitud y la disponibilidad efectiva de los medicamentos, así como las complicaciones en el procedimiento que tuvieron un impacto en el cumplimiento de la medida. Después de analizar los datos, no se confirmó la deducción inicial, y el trabajo concluyó que el tiempo promedio entre la orden judicial preliminar y el uso efectivo del medicamento es inherente a los pasos internos "burocráticos", y no puede establecer un término promedio ideal, siendo posible, sin embargo, minimizar ese tiempo.A saúde é um direito de todos e um dever do Estado, sua efetivação pode ser demandada pela via judicial, inclusive no que diz respeito ao fornecimento de medicamentos para tratamento médico não ofertado pelo Estado por meio do SUS, seja por não haver protocolo para tanto ou por falta em estoque. Logo, este trabalho tem por finalidade verificar se é possível se falar em efetividade das tutelas de urgência concedidas em ações judiciais que pleiteam medicamentos na subseção judiciária de Caruaru, em Pernambuco, pela análise de algumas ações propostas pela Defensoria Pública da União em Caruaru entre 2018 e 2020. Para tanto, o artigo, pelo método dedutivo, partiu da premissa de que há inefetividade das tutelas de urgência na citada Subseção, considerando o tempo de concretização dessas, e analisou, por pesquisa mista (quali-quantitativa), 10 (dez) ações que pleiteia(ra)m o fornecimento de medicamento com pedido de tutela de urgência deferido. Observou-se nas ações o tempo entre o deferimento do pedido e a efetiva disponibilização dos medicamentos, bem como as intercorrências no procedimento que repercutiram no cumprimento da medida.
