Resumo: This paper aims to analyze, in a contemporary view, the Public Defender’s Office role of promotion and protection of human rights, which is constitutionalized by Constitutional Amendment no. 80/2014. In order to do so, it was sought to research the Brazilian Constitutions and identify the birth of the Institution, as well as its functions and the evolution of judiciary assistance to juristic assistance, complemented with the attributions of collective and social order, and the three current theories related to this subject. In addition, an attempt was made to analyze the conception of human rights, its characteristics and dimensions, and thereafter to carry out a study about the promotion of human rights in relation to the idea of recognition of vulnerable groups.

Para tanto, se buscó investigar sobre las Constituciones brasileñas e identificar el nacimiento de la Institución, así como de sus funciones, y la evolución de la asistencia judicial para la asistencia jurídica, que se complementan con las atribuciones de orden colectivo y social, y las tres teorías actuales relacionadas con el tema. Además, se buscó analizar la concepción de los Derechos Humanos, sus características y dimensiones para, a continuación, realizar un estudio sobre la promoción de los Derechos Humanos relacionándola con la idea de reconocimiento de los grupos vulnerables.Este trabalho tem por intuito analisar, com uma visão contemporânea, o papel de promoção e proteção dos Direitos Humanos pela Defensoria Pública constitucionalizado pela Emenda Constitucional nº 80/2014. Para tanto, buscou-se pesquisar sobre as Constituições brasileiras e identificar o nascimento da Instituição, bem como de suas funções, e a evolução da assistência judiciária para assistência jurídica, complementadas com as atribuições de ordem coletiva e social, e as três teorias atuais relacionadas ao assunto.
