The structural racism in front of the (in)effectiveness of measures to fight racial discrimination in Brazil: an analysis from the treatment of racial crimes in the state of Paraná

Resumo: This research investigates the fight against racial discrimination in Brazil based on institutionalpractices, in particular the “report on the handling of racial crimes in the state of Paraná,” prepared by the Working Group on Ethnorracial Policies of the Union Public Defensorship in partnership with the Human Rights and Citizenship Commission of the Legislative Assembly of Paraná. From this report, this study aims to evaluate the (in) effectiveness of the repressive measures proposed by Brazilian Law, based on the concepts of institutional racism and structural racism discussed by Silvio Luiz de Almeida. The lackof effectiveness and institutional preparation in attending, investigating, and processingracial crimes in Paraná reflects a Law that consistently maintains white privilege to thedetriment of facing racism as a systemic social, historical, and political process. This studyis guided by the Critical Race Theory, recognizing the importance of the race criterion in reflections on Brazilian Law and, consequently, in confronting its supposedly universal and neutral character.

A partir dos dados reunidos no relatório, objetiva-se avaliar a (in)eficácia das medidas repressivas trazidas pela legislação brasileira, tendo como referencial teórico os conceitos de racismo institucional e racismo estrutural, analisados por Silvio Luiz de Almeida. Como resultado, identifica-se a falta de efetividadee preparo institucional no atendimento, na apuração e no processamento de crimes raciais no Paraná enquanto reflexo de um Direito que continuamente promove a manutenção do privilégio branco, ao passo que não enfrenta ao racismo enquanto processo social sistêmico, histórico e político.
