Digital preservation policies: mapping of legal aspects in Brazil and Mozambique

Resumo: Aiming to bring up the state of the art of Digital Preservation Policies to raise more institutional and/or governmental actions and deepen the academic debate around access to digital information that, in itself, supports the decision-making process, a mapping of legal aspects as part of the basic requirements for the formulation of a Digital Preservation Policy was made. The work is part of a qualitative, exploratory approach, materialized by bibliographic and documentary research, having explored theoretical texts from books and articles from scientific journals, as well as legal texts, from the Constitution of the Republic of each country, laws and decrees that allowed the construction of the theoretical framework oriented towards the digital object, digital preservation and the digital preservation policy. The material collected through observation underwent a process of categorization and systematization and was subsequently treated based on the content analysis method. It was found that Brazil and Mozambique have norms that circumscribe Digital Preservation and that can guide the construction of institutional and/or national Digital Preservation Policies, however, in both realities, no specific legal instrument that regulates the matter was identified. In the Brazilian context, Digital Preservation Policies have been developed, particularly in universities, in response to the demands caused by the continuous evolution of Information and Communication Technologies. In the set of instruments related to digital preservation, there are terminological jumble between “conservation and preservation; electronic and digital” and other similar terms, with greater incidence in the Mozambican context. It should be noted that, in Mozambique, there is talk of digital transformation (through digitization), but there is no mention of Digital Preservation and the guidelines related to this process. However, it is concluded that the inexistence of a Digital Preservation Policy (national) in Mozambique cannot inhibit institutions from moving forward with the elaboration of institutional policies that base and outline the guidelines of professional action in a process that makes the preservation of information in the long term effective and accessible with guarantees of authenticity and integrity.

El trabajo se enmarca en un abordaje cualitativo, exploratorio, materializado por la investigación bibliográfica y documental, habiendo explorado textos teóricos de libros y artículos de revistas científicas, así como textos legales, de la Constitución de la República de cada país, leyes y decretos que permitió la construcción del marco teórico orientado hacia el objeto digital, la preservación digital y la política de preservación digital. El material recolectado a través de la observación pasó por un proceso de categorización y sistematización y posteriormente fue tratado con base en el método de análisis de contenido. Se constató que Brasil y Mozambique cuentan con normas que circunscriben la Preservación Digital y que pueden orientar la construcción de Políticas de Preservación Digital institucionales y/o nacionales, sin embargo, en ambas realidades, no se identificó ningún instrumento legal específico que regule la materia. En el contexto brasileño, las Políticas de Preservación Digital se han desarrollado, particularmente en las universidades, en respuesta a las demandas provocadas por la evolución continua de las Tecnologías de la Información y la Comunicación. En el conjunto de instrumentos relacionados con la preservación digital, existen errores terminológicos entre “conservación y preservación; electrónico y digital” y otros términos similares, con mayor incidencia en el contexto mozambiqueño. Cabe señalar que, en Mozambique, se habla de transformación digital (a través de la digitalización), pero no se menciona la Preservación Digital y las pautas relacionadas con este proceso. Sin embargo, se concluye que la inexistencia de una Política de Preservación Digital (nacional) en Mozambique no puede impedir que las instituciones avancen en la elaboración de políticas institucionales que basen y delineen las pautas de actuación profesional en torno a un proceso que haga efectiva la preservación de la información. a largo plazo y a los que se pueda acceder con garantías de autenticidad e integridad.Com o objetivo de dar a conhecer o estado da arte das Políticas de Preservação Digital para suscitar mais ações institucionais e/ou governamentais e aprofundar o debate académico em torno do acesso à informação digital que, de per si, apoia o processo decisório, fez-se um mapeamento dos aspetos legais como parte dos requisitos básicos para a formulação de uma Política de Preservação Digital.  O trabalho insere-se numa abordagem qualitativa, do tipo exploratória, materializada pelas pesquisas bibliográfica e documental, tendo sido explorados textos teóricos a partir de livros e artigos de revistas científicas, bem como textos legais, desde a Constituição da República de cada país, leis e decretos que permitiram a construção do referencial teórico orientado ao objeto digital, preservação digital e à política de preservação digital. O material recolhido por meio de observação passou por um processo de categorização e sistematização tendo sido, posteriormente, tratado com base no método de análise de conteúdo. Constatou-se que Brasil e Moçambique apresentam normas que circunscrevem a Preservação Digital e que podem orientar a construção de Políticas de Preservação Digital institucionais e/ou nacionais, contudo, nas duas realidades, nenhum instrumento legal específico que regule sobre a matéria foi identificado. No contexto brasileiro tem-se assistido a elaboração de Políticas de Preservação Digital, em particular, nas universidades, em resposta às demandas provocadas pela contínua evolução das Tecnologias de Informação e Comunicação. No conjunto de instrumentos conexos à preservação digital, notam-se equívocos terminológicos entre “conservação e preservação; eletrônico e digital” e demais termos afins, com maior incidência no contexto moçambicano. Refira-se que, em Moçambique fala-se da transformação digital (por meio da digitalização), mas não se fala da Preservação Digital e das diretrizes atinentes à este processo.
