Debates on the restriction of access to personal information in Brazilian Legislation (1986-1991)

Resumo: The end of the military dictatorship (1964-1985), in Brazil, individuals and groups from civil society saw the possibility of accessing information and documents from public bodies. In early 1986, the Ministry of Justice was working on a package of laws aimed at removing the rubble of authoritarianism, an expression used at the time. Among the studies that were under development was the draft law on access to information and protection of privacy. Despite not being processed in Congress, the draft was widely discussed in the government and among society. It determined society's access to the archives of federal public agencies. The objective is to understand why the law on access to information was not passed through Congress in the mid-1980s, and this understanding will help to clarify the determinations of the Federal Constitution of 1988 and Law No. 9.158/1991. The investigation of an exploratory nature used qualitative, descriptive, bibliographic and documentary analysis. An analysis of journalistic materials published between 1984 and 1991 in periodicals of wide circulation was carried out, in addition to the analysis of documents from the National Information Service fund, guarded by the National Archives. The analysis made it possible to perceive that the Armed Forces and the so-called information community and civil society subjects exerted influences to prevent society from accessing documents in the SNI archive. They made it impossible for citizens to have access to documents containing information about them. Another relevant aspect refers to the persistent pressure exerted by subjects and groups in society for access to the SNI archives to be granted, and there is the presence of an opposing force that is also permanently present and sought to prevent access. Finally, there is the dissatisfaction of groups in society about the legislation that defined the deadlines for access to archives.

A principios de 1986, el Ministerio de Justicia estaba trabajando en un paquete de leyes destinadas a remover los escombros del autoritarismo, expresión utilizada en ese momento. Entre los estudios que se encontraban en desarrollo se encontraba el proyecto de ley de acceso a la información y protección de la privacidad. A pesar de no ser tramitado en el Congreso, el proyecto fue ampliamente discutido en el gobierno y entre la sociedad. Determinaba el acceso de la sociedad a los archivos de las dependencias públicas federales. El objetivo es comprender por qué la ley de acceso a la información no fue aprobada en el Congreso a mediados de la década de 1980, y este entendimiento ayudará a esclarecer las determinaciones de la Constitución Federal de 1988 y la Ley No. 9.158/1991. La investigación de carácter exploratorio utilizó análisis cualitativo, descriptivo, bibliográfico y documental. Se realizó un análisis de materiales periodísticos publicados entre 1984 y 1991 en periódicos de amplia circulación, además del análisis de documentos del fondo del Servicio Nacional de Información, custodiado por el Archivo Nacional. El análisis permitió percibir que las Fuerzas Armadas y los llamados sujetos de la comunidad de la información y de la sociedad civil ejercían influencias para impedir que la sociedad accediera a los documentos del archivo del Servicio Nacional de información - SNI. Hicieron imposible que los ciudadanos tuvieran acceso a los documentos que contenían información sobre ellos. Otro aspecto relevante se refiere a la persistente presión ejercida por sujetos y grupos de la sociedad para que se otorgue el acceso a los archivos del SNI, existiendo la presencia de una fuerza opositora que también está permanentemente presente y busca impedir el acceso. Finalmente, está el descontento de grupos de la sociedad sobre la legislación que definió los plazos de acceso a los archivos.Encerrada a ditadura militar (1964-1985), no Brasil, sujeitos e grupos da sociedade civil visualizaram a possibilidade de acessar informações e documentos de órgãos públicos. Em início de 1986, o Ministério da Justiça estava trabalhando em um pacote de leis com o objetivo de remover o entulho do autoritarismo, expressão utilizada no período. Entre os estudos que estavam em desenvolvimento, estava o do anteprojeto da lei de acesso à informação e da proteção da vida privada. Apesar de não chegar a tramitar no Congresso, o anteprojeto foi amplamente discutido no governo e entre a sociedade. Determinava sobre o acesso da sociedade aos arquivos de órgãos públicos federais. Objetiva-se compreender por quais motivos a lei de acesso à informação não tramitou no Congresso em meados dos anos de 1980 e, este entendimento ajudará a esclarecer sobre as determinações da Constituição Federal de 1988 e da Lei n º 8.159/1991 a respeito do acesso. A investigação de cunho exploratório, utilizou-se da análise qualitativa, descritiva, bibliográfica e documental. Foi realizada a análise de matérias jornalísticas publicadas, entre 1984 e 1991, em periódicos de grande circulação, além da análise de documentos do fundo Serviço Nacional de Informações, custodiado pelo Arquivo Nacional. A análise permitiu perceber que as Forças Armadas e a chamada comunidade de informação e sujeitos da sociedade civil exerceram influências para impedir o acesso da sociedade aos documentos do arquivo do Serviço Nacional de Informações - SNI. Impossibilitaram que o cidadão tivesse acesso aos documentos que contivessem informações sobre ele. Outro aspecto relevante refere-se à persistente pressão exercida por sujeitos e grupos, na sociedade para que o acesso aos arquivos do SNI fosse concedido e, há a presença de uma força contrária também permanentemente presente e que buscou impedir o acesso.
