ESTADO DEMOCRÁTICO DE DIREITO, DEMOCRACIA E FUNÇÃO JURISDICIONAL

Resumo: This article aims to highlight the role of the Judiciary in a Democratic State of Law, especially in times of political, economic and social uncertainties, moments in which society most seeks the Judiciary searching for concretization of constitutional promises. It begins with the evolution of the role of the State in society, from the French Revolution to the present day, with brief references to generations of rights, and to positivist and post-positivist doctrines. It distinguishes between the phenomenon of judicialization and the activist posture of the magistrates to conclude, in the end, by the need for everyone to understand that in a democracy, powers are harmonic and independent of each other, and it is upon the magistrate to understand that the act of judging is not an act of will, but knowledge, in the exercise of a State function, which imposes on it a systematic and harmonious interpretation of the Constitution and the laws of the country, in the name of which it must act, without forgetting the deference necessary to the performance of the others Powers of the Republic, within the limits of their constitutional attributions.

Parte da evolução do papel do Estado na sociedade, desde a Revolução Francesa até os dias atuais, com breves referências às gerações dos direitos, e às doutrinas positivistas e pós-positivistas.
