Resumo: Human rights do not arise from nature, they are not metaphysical attributes. They also do not follow from the norm. Human rights arise from the culture of each people. The classification of rights into generation hierarchizes them and provides the opportunity for the State to program what it considers relevant to implement. Such a conception grounds the reservation of what is possible and postpones the substantial realization of the holder's right.
