Extraterritorial validity of the conflict mediation agreement in a private chamber

Resumo: This article aims to elucidate the extraterritorial validity of the mediation agreement held in a private chamber, regardless of the domicile of the parties or the city where the event occurs. The effectiveness against third parties of private mediation regardless of judicial approval, except when required by law, and it remains to be seen which competent court. The Mediation Law, 13,140 / 2015, in its article 3, paragraph 2, determines that agreements that deal with unavailable rights, id est, but which can be negotiated or compromised, must be approved by the competent judges and pass the scrutiny of the Public Ministry . However, the Law refrains from informing which is this competent court. The tendency is for such conflicts to be dismissed, as determined by § 3, article 3, of the Brazilian Code of Civil Procedure, being referred to the Municipal Chambers of mediation to resolve the dispute. What gives legal certainty to the parties is the term of the mediation agreement, and not the place of its approval.

La efectividad frente a terceros de la mediación privada independientemente de la aprobación judicial, salvo cuando la ley lo requiera, y queda por ver qué tribunal competente. La Ley de Mediación, 13.140 / 2015, en su artículo 3, párrafo 2, determina que los acuerdos que traten sobre derechos indisponibles, id est, pero que puedan ser negociados o comprometidos, deberán ser ratificados por el tribunal competente y pasar por el escrutinio del Ministerio Público. Sin embargo, la Ley se abstiene de informar cuál es este tribunal competente. La tendencia es que tales conflictos sean desestimados, según lo determina el § 3, artículo 3, del Código de Procedimiento Civil brasileño, refiriéndose a las cámaras privadas de mediación para resolver la disputa. Lo que da seguridad jurídica a las partes es la duración del acuerdo de mediación y no el lugar de su aprobación.O presente artigo tem como objetivo elucidar a validade extraterritorial do acordo de mediação realizado em câmara privada, independente do domicílio das partes ou da cidade que ocorreu o fato. A eficácia contra terceiros da mediação privada independente de homologação judicial, exceto quando a Lei exige, restando saber qual juízo competente. A Lei de mediação, 13.140/2015, em seu artigo 3º, §2º, determina que os acordos que tratam de direitos indisponíveis, id est, mas que podem negociar ou transigir, deverão ser homologados pelo juízo competente e passar pelo crivo do Ministério Público. No entanto, a Lei se abstém de informar qual é este juízo competente. A tendência é que tais conflitos sejam desjudicializados, como determina o § 3º, artigo 3º, do Código de Processo Civil Brasileiro, remetendo-se às câmaras privadas de mediação para solucionar o litígio.
