Resumo: | This article aims to lift the veil of patrimonial violence against women existing in family courts and disguised as litigations over child support defaults or common assets fraud. While the common assets fraud embodies the lack of structural recognition of female participation in the wealth creation during the conjugal period, child support defaults demonstrates how much the holder of economic power can actively bully the most vulnerable party of the marital relationship; these situations are discussed on a daily basis in the Judiciary, which should understand it's fundamental role in defending substantial gender equality provided by the CRFB 1988, in order to enforce substantial effectiveness that has been achieved so far in family courts. |
