Resumo: | The purpose of this article is to verify which types ofinsurance are predicted for environmental management and whether this isan effective instrument for the management of contaminated sites. Thisis a relevant and current issue as the number of contaminated areas inBrazil grows, and in the state of São Paulo, more than 6.000 areas wereidentified with environmental liability from 2002 to 2019. For that, an exploratory research was done to identify what exists in the Brazilian doctrine, especially the Cuban doctrine, regarding the environmental insurance theme. The relevant points addressed were: the procedures developed for the identification and management of acontaminated area, the difference between environmental insurance andguarantee insurance, and the aspects to be considered for risk anddamage identification and valuation. The contribution of this studyconsists in pointing out the challenges for the identification ofdifferent scenarios of environmental risks, showing that the conclusionof the insurance contract deserves care on the part of the insurer andthe contractor. |

El tema cobra relevancia y actualidad a medida que crece el número de áreas contaminadas en Brasil, y solo en el Estado de São Paulo, se identificaron más de 6.000 áreas con pasivos ambientales entre los años 2002 y 2019. Por lo tanto, el trabajo se realizó a partir de una investigación exploratoria con el fin de identificar lo que existe en las doctrinas brasileñas y extranjeras, especialmente la cubana, sobre el tema de los seguros ambientales. Se destacan como puntos relevantes abordados los siguientes: los procedimientos desarrollados para la identificación y gestión de un área contaminada, la diferencia entre el seguro ambiental y el seguro de garantía, y los aspectos a considerar para la identificación y valoración de riesgos y daños. Como conclusiones, se señalan los desafíos para la identificación de diferentes escenarios de riesgos ambientales, ya que muestran que la celebración del contrato de seguro merece un cuidado por parte de la aseguradora y, por parte del contratista.O objetivo deste artigo é verificar as modalidades de seguro previstas para a gestão ambiental e investigar se tais modalidades são instrumentos eficazes para o gerenciamento de áreas contaminadas. A temática se torna relevante e atual à medida que cresce o número de áreas contaminadas no Brasil, sendo que, somente no Estado de São Paulo, foram identificadas mais de 6.000 áreas com passivo ambiental entre os anos de 2002 e 2019. Para tanto, o trabalho foi realizado a partir de uma pesquisa exploratória com o intuito de identificar o que existe nas legislações e doutrinas brasileira e estrangeira, especialmente a cubana, referente ao tema de seguro ambiental. A escolha da experiência cubana se justifica por permitir um contraponto relevante com a experiência brasileira: tem-se um tímido mercado securitário cubano, sob controle estatal; e um promissor mercado de seguros no Brasil, lastreado no sistema econômico capitalista. Destacam-se como pontos relevantes da pesquisa: os procedimentos para identificação e gestão de uma área contaminada; os aspectos para a identificação e valoração dos riscos e danos; e a diferença entre o seguro ambiental e o seguro garantia.
