Resumo: This study aims to identify the relationship between neoliberal development and violations of the human right to an ecologically balanced environment. To this end, the research addresses the concept of neoliberal rationality, how the system presents itself today, its premises and consequences, and its relationship with the protection of the environment. In addition, the work clarifies the definition of the human right to an ecologically balanced environment, how it is recognized in modern constitutions and international treaties on the matter, and what are the contours of this human right and its importance today. Furthermore, this study presents alternatives to the neoliberal rationality and worldview, based on counter-hegemonic theories of human rights (Epistemologies of the South). The development of the study has as approach the analectic method, thought by Enrique Dussel.

Para tal fin, la investigación aborda el concepto de racionalidad neoliberal, cómo se presenta el sistema en la actualidad, sus premisas y consecuencias y su relación con la protección del medio ambiente. Además, la obra explica la definición del derecho humano a un medio ambiente ecológicamente equilibrado, cómo se reconoce en las constituciones modernas y en los tratados internacionales sobre la materia, cuáles son los contornos de ese derecho humano y su importancia en la actualidad. También, este estudio presenta alternativas a la racionalidad y la cosmovisión neoliberales, basadas en teorías contrahegemónicas de los derechos humanos (Epistemologías del Sur). El desarrollo del estudio se basa en el método analítico, ideado por Enrique Dussel.Este estudo tem como objetivo identificar qual é a relação entre o desenvolvimento neoliberal e as violações ao direito humano a um meio ambiente ecologicamente equilibrado. Para isso, a pesquisa aborda o conceito de racionalidade neoliberal, como o sistema se apresenta nos dias atuais, suas premissas e consequências e sua relação com a proteção do meio ambiente. Ademais, o trabalho explicita a definição do direito humano ao meio ambiente ecologicamente equilibrado, como ocorre seu reconhecimento nas constituições modernas e nos tratados internacionais sobre a matéria, quais são os contornos desse direito humano e sua importância na atualidade. Ainda, este estudo apresenta alternativas à racionalidade e visão de mundo neoliberal, com base nas teorias contra-hegemônicas dos direitos humanos (Epistemologias do Sul).
