This scientific work focuses on analyzing the direct action of unconstitutionality (ADI) 2.656-9 / SP, filed by the State of Goiás Governor aiming to declare the unconstitutionality of some provisions of Law 10,813 / 2001, the State of São Paulo , which limited the import, extraction, processing, marketing, manufacturing and installation of products or materials containing any type of asbestos. The problem comes from the State of Goiás fact depend economically exploration of asbestos and the State of São Paulo is the main market. Aims to clarify the discussion points put on trial, especially the fundamental rights to health and to an ecologically balanced environment and the circumstances of the unconstitutionality and some details about the historical and economic aspects of Minaçu/GO, location of exploration asbestos. Therefore, it will make use of the methods with bibliographical and jurisprudential research. The conclusions are based on the preponderance of the fundamental right to health and the environment, to the detriment of the procedures laid on the constitutional rules of division of powers between the federal entities, in order to preserve the foundation stones under the protective bias of human dignity and citizenship.
