A Participação da Comunidade na Proteção ao Patrimônio Cultural: Uma Análise do Decreto-Lei de Nº. 25/1937 à Luz da Constituição Federal de 1988

Durante anos de tentativas que culminaram na feitura de diversos anteprojetos, a criação do Decreto-lei de nº. 25/1937 representou um marco legislativo, principalmente por ser posterior às Constituições de 1934 e a própria de 1937, as que por primeiro abrigaram disposições restritivas da ideia de propriedade absoluta. Inovador e vanguardista, o Decreto-lei sofreu com muitas críticas e tentativas de revogação, mas permaneceu, mesmo com a entrada em vigor da Constituição Federal de 1988, e mantém-se como uma referência simbólica à proteção ao patrimônio cultural material. O presente trabalho procura fazer uma análise da participação da comunidade na preservação e promoção do patrimônio cultural brasileiro, após a previsão expressa da Constituição Federal de 1988, como dever tanto da comunidade, como do Poder Público. O Decreto-lei de nº. 25/1937, tomado como referência, nesse sentido, uma vez que prevê o tombamento, instituto utilizado para a preservação de bens materiais, sejam eles móveis ou imóveis e que detenham valor cultural, torna-se relevante para o estudo e verificação dessa participação social. AbstractDuring years of attempts that culminated in the making of several drafts, the creation of the Decree-Law n º. 25/1937 was a landmark legislation, especially for being later to the Constitutions of 1934 and even 1937, which first housed the restrictive provisions of the idea of absolute ownership. Innovative and avant-garde, the ordinance has suffered much criticism and attempts to withdraw, but remained even with the entry into force of the Constitution of 1988 and stands as a symbolic reference to the protection of cultural heritage material. This paper attempts to analyze the participation of the community in the preservation and promotion of cultural heritage of Brazil, after the express provision of the Constitution of 1988 as the duties of both the community as the Government. Decree-Law No. 25/1937, taken as a reference in this regard, since it provides for the registration, the institute used for the preservation of property, whether movable or immovable and which have cultural value, it becomes important to study and verification of social participation. KeywordsDecree-Law nº 25.
