Who Belongs to Biodiversity? A Look About the Brazilian Regulatory Framework

Resumo: The biodiversity theme gained notoriety from the negotiation and signing of the Convention on Biological Diversity, during the United Nations Conference on Environment and Development held in Rio de Janeiro in 1992. Since then, Brazil has adopted a series of measures to meet the provisions of the Convention and for the preservation of its biological heritage. In June 2014, was presented to the National Congress Bill 7735/2014, which proposes significant changes in the Constitution and Decree 2519/1988, with regard to access to genetic resources, protection and access to traditional knowledge and the benefit-sharing for sustainable use of biodiversity. The purpose of this article is to point out what are the changes proposed by that bill and what the consequences for the protection and preservation of the biological heritage of the country.

Desde então, o Brasil, adotou uma série de medidas para atender ao disposto na Convenção, bem como para a preservação do seu patrimônio biológico. Em junho de 2014, foi apresentado ao Congresso Nacional o Projeto de Lei 7735/2014, que propõe mudanças significativas na Constituição Federal e no Decreto 2519/1988, no que tange ao acesso ao patrimônio genético, a proteção e acesso ao conhecimento tradicional e a repartição de benefícios para o uso sustentável da biodiversidade.
