COMPLIANCE IN THE BRAZILIAN GOVERNMENT: THE CASE OF THE COVENANT FOR INTEGRITY IN THE MINISTRY OF AGRICULTURE, LIVESTOCK AND SUPPLY

Resumo: | It is the process of implementing anticorruption compliance policies in the Brazilian Federal government, focusing not only on the legal milestones and regulations, but also on the tactical and operational challenges to implement initiatives, under the qualitative and descriptive context, taking as a background the publication of the Anti-Corruption Law (Law No. 12.846/2013), the federal programs to promote the implementation of integrity policies, and also the running integrity program at the Ministry of Agriculture, Livestock and Food Supply (“MAPA”), so-called “Agro +” Integrity Program. It was developed as a consequence of corruption that was installed in the agribusiness sector. Recently, the Operation “Carne Fraca”. It was also important to mention the creation of the “Agro +” Integrity Seal, as an unprecedented sectorial award from the Federal Government aimed at recognizing the efforts of agribusiness companies. Inserting this practice of external promotion into the Integrity Plan of a public entity of the Brazilian Federal government, despite challenging, is the opportunity to demonstrate how this tool can contribute to minimize the risks of corruption and misconduct, internally and externally to the government agency, and serve as a good example for other public agencies. However, it is also necessary to insert and evolve this new culture of good practices within institutions, creating an effective channel for exchanging experience in order to avoid harmful damages that can jeopardize the image of public and private institutions in the national and international markets. |

However, it is also necessary to insert and evolve this new culture of good practices within institutions, creating an effective channel for exchanging experience in order to avoid harmful damages that can jeopardize the image of public and private institutions in the national and international markets.Trata-se do processo de implementação de políticas de compliance anticorrupção em órgão da administração pública direta do Poder Executivo Federal, com enfoque não somente nos marcos legais e infralegais, mas especialmente no desafio tático e operacional para implantação das ações, sob o enfoque qualitativo e descritivo, tomando como pano de fundo a publicação da Lei Anticorrupção (nº 12.846, de 2013), os programas federais de fomento à implementação das políticas de integridade e, mais detalhadamente, o Programa de Integridade em execução no Ministério da Agricultura, Pecuária e Abastecimento (MAPA), denominado Programa Agro+ Integridade, desenvolvido como uma resposta ao quadro de corrupção que se verificou instalado no setor do agronegócio, conforme se viu na recente Operação Carne Fraca. Ressalta-se ainda a criação do Selo Agro+ Integridade, como inédita premiação setorial do governo Federal voltada ao reconhecimento dos esforços das empresas do agronegócio. Inserir essa prática de fomento externo em Planos de Integridade de entidades públicas da administração federal direta, apesar de desafiador, é a oportunidade de demonstrar como essa ferramenta pode contribuir para minimizar os riscos de corrupção e desvios de conduta, interna e externamente ao órgão público, e servir de exemplo para outros Órgãos Públicos. Entretanto, já nas reflexões finais sobre o tema, serão abordados os desafios futuros ligados à necessidade de amadurecimento nessa nova cultura de práticas íntegras dentro das instituições públicas e privadas, criando um canal efetivo de trocas de experiência, objetivando evitar os nefastos danos que comprometem a imagem das instituições públicas e privadas perante o mercado nacional e internacional.
