THE INSTITUTIONALIZATION OF GENDER VIOLENCE IN THE WOMEN'S RE-EDUCATION CENTER (CRF) OF ANANINDEUA AS A MANIFESTATION OF THE ABSENCE OF PUBLIC POLICIES AIMED AT INCARCERATED WOMEN

Resumo: | With the advent of the Welfare State, governability adopted a more participatory social dynamic, rooted in the foundations of contemporary constitutionalism. In this scenario, collective injunctions, as a legacy of North American class actions, began to play a crucial role in the realization of fundamental social rights, allowing the approximation between justiciability and popular participation in the elaboration and execution of public policies, which have as main objective assistance to the most vulnerable sections of society. In this way, the present article brought to the heart of the discussion the study of the reality experienced by a minority, unpopular and segregated portion of the population of Pará: the inmates of the Ananindeua Women's Reeducation Center (WRE). We sought to investigate how the gender violence suffered by those incarcerated in the CRF implies the absence of public policies aimed at incarcerated women. To this end, the work dealt with the importance of collective participation instruments, the criticism that falls on judicial activism and the political influences on the decision-making process of budget priorities. The method chosen was the deductive one, with a quali-quantitative approach, based on a case study. Bibliographic, documentary and field research were used as data collection instruments. |

Bibliographic, documentary and field research were used as data collection instruments.Com o advento do Estado de Bem-Estar Social, a governabilidade adotou uma dinâmica social mais participativa, fincada às bases do constitucionalismo contemporâneo. Nesse cenário, as tutelas coletivas, como herança das class actions norte-americanas, passaram a exercer papel crucial na concretização dos direitos fundamentais sociais, permitindo a aproximação entre justiciabilidade e participação popular na elaboração e execução de políticas públicas, as quais têm como objetivo principal o atendimento às parcelas mais vulneráveis da sociedade. Desse modo, o presente artigo trouxe ao cerne da discussão o estudo da realidade vivenciada por uma parcela minoritária, impopular e segregada da população paraense: as detentas do Centro de Reeducação Feminino (CRF) de Ananindeua. Buscou-se investigar de que modo a violência de gênero sofrida pelas encarceradas deste Centro implica ausência de políticas públicas voltadas para mulheres encarceradas. Para tanto, o trabalho tratou da importância dos instrumentos de participação coletiva, da crítica que recai sobre o ativismo judicial e das influências políticas sobre o processo decisório de prioridades orçamentárias. O método escolhido foi o dedutivo, com abordagem qualiquantitativa, a partir de estudo de caso.
