Resumo: The objective of this work is to present the ideas and practices of the intellectual Silvia Rivera Cusicanqui’s indigenous episteme about the Ch’ixi world as a response to the crisis of the rule of law and constitutionalisms. Methodologically, a bibliographical research is carried out, with a deductive method of approach and analytical-descriptive analysis. In the end, it is concluded that it is important to have knowledge other than Eurocentric knowledge in order to respond legally to the contradictions faced in the logic of the inclusion of fundamental rights.

Metodologicamente, realiza-se uma pesquisa bibliográfica, de método dedutivo de abordagem e analítico-descritivo de análise.
