MUNICIPAL URBAN PLANNING, FLEXIBILITY AND OPPORTUNITIES: A LEGAL PERSPECTIVE

Resumo: One of the most pressing questions facing current urban planning is the level of density and flexibility that municipal plans can have in regulating land occupation. It is therefore questioned whether the plan should regulate the occupation of the territory to the smallest detail, with urban management being the mere application of its rules to concrete situations, or whether it should define only the essential of this occupation, referring to the management a creative embodiment of its norms, within the general framework defined therein. The current trend has been to privilege flexibility in detriment of the normative rigidity of "traditional" urban plans, analyzing, in this text, the models and techniques that can be used for this purpose.

Questiona-se, assim, se o plano deve regular a ocupação do território até ao mais ínfimo pormenor, cabendo à gestão urbanística a mera aplicação das suas regras às situações concretas, ou se ele deve definir apenas o essencial dessa ocupação, remetendo para a gestão urbanística uma concretização criadora das suas normas, dentro do quadro geral nele definido.
