Resumo: This article aims to show, based on a data collection made in Paraíso do Tocantins -TO, how the criminal law and current drug policy in Brazil contribute to the process of segregation and labeling of a certain social class. From the principles of minimum intervention and human rights, we intend to propose another reading of the role of criminal law in our society and a necessary reconsideration of the basis of current drug policy in Brazil.
