Resumo: This article proposes discussions about property as a right established, in current terms, based on the modern conception of universal natural law. The guiding problem is to understand to what extent the right to modern property is tensioned by the promise of universality of human rights. From a methodological point of view, this is purely theoretical, fundamental or basic research, whose sources are bibliographic. The text is divided into three parts. Firstly, aspects of the historiography of modern law are discussed. Subsequently, the promise of universality and its relationship with the construction of human rights are discussed. Finally, the right to modern property and its abstraction are analyzed. Approached through the prism of the sacredness of a natural right, it reflects, in the end, on the impact of this approach on problems faced today.

Tem-se como problemática norteadora perceber em que medida o direito à propriedade moderna é tensionado pela promessa de universalidade dos direitos humanos. Do ponto de vista metodológico, trata-se de pesquisa puramente teórica, fundamental ou básica, cujas fontes são bibliográficas. O texto está dividido em três partes. Primeiramente, são discutidos aspectos sobre a historiografia do direito moderno. Posteriormente, debate-se a promessa de universalidade e sua relação com a construção dos direitos humanos. Por fim, analisa-se o direito à propriedade moderna e sua abstração. Abordada pelo prisma da sacralidade de um direito natural, reflete-se, ao final, sobre o impacto dessa abordagem para problemas enfrentados na atualidade.
