The promotion of sustainable national development has become increasingly important, and the state, as guarantor of the precepts established by the 1988 Federal Constitution, is responsible for its implementation. The necessary observance of sustainability in the consumer market is analyzed, as well as the power of the state-buyer to promote conduct that contributes to the preservation of the environment. The evolution of the issue in the context of public tenders is studied, as well as its obligation, as it is a guiding principle of Law 14.133/2021. The bidding documents of the Municipality of Itarema, in the state of Ceará, were examined in order to ascertain the use of sustainability criteria in contracts for the acquisition of goods and services in the first half of 2023. The conclusion is that although there is a whole legal apparatus, the public body has been inert in adopting mechanisms to promote sustainable development in public tenders. The consequences of the omission and possible solutions to the problem are pointed out. The research is bibliographical and documental, using the deductive method.
