THE ENVIRONMENT AS A PRINCIPLED HUMAN RIGHT IN THE UN'S 2030 AGENDA

This paper analyzes the protection of the environment, taking into account its principled nature as a human right. For this discussion, the following research problem was formulated: Does the protection of the environment have the principiological character of a human right to quality of life and is it included in the goals for sustainable development of the UN's 2030 Agenda? Its general objective is to analyze the principiological character of the human right to the environment and its legal protection in the domestic and international spheres, based on the theory of integrity and coherence proposed by Ronald Dworkin. The specific objectives are: a) to study the guiding principles of environmental protection in the Brazilian legal system; b) to analyze environmental law from the perspective of human rights and, c) to identify the contribution of Dworkin's proposal of coherence and integrity as an epistemological basis for revealing the protection of the environment as a principle of the human right to quality of life. The theoretical deepening is based on bibliographical research, embodied in the reading of various works and documents, based on the hypothetical-deductive method. As a result, it was observed that the proposal of coherence and integrity formulated by Ronald Dworkin is apt to identify the protection of the environment as a principle of the human right to quality of life.
