Rural credit in Brazil: contrat's evolution at an institutional approach

Resumo: | This article outlines a New Institutional Economics’ approach of rural credit. The mainstream relies in the understanding that the rural credit contracts are hybrid forms in response to the agrichain´s complexity. The object of the research was operational credit contract for soybeans farms. The research consisted on qualitative researches in the extent that they sought to comprehend in a more profound level the rules of game for the rural financing contracting environment based on the economic agent’s perceptions. The results highlighted the agent’s perception that the judicial system is not strong enough to performance an efficient enforcement of the contracts. In response to this institutional challenge, the agents and the government manage adaptations in the contracts, which has been successful in the agent’s point of view. In the other hand, the informational system has showed weaknesses in protecting the creditor’s right. This scenario open breaches to opportunist actions and adverse selection. In order to mitigate these problems the agents govern interdependent transactions as a tool for risk sharing. |

In order to mitigate these problems the agents govern interdependent transactions as a tool for risk sharing.Visto que as transações ocorrem inseridas em um ambiente institucional com custo de transação positivo, esse sistema de regras e normas determina a forma como os agentes realizam suas trocas e como os direitos de propriedade são alocados. O entendimento das regras do jogo permite compreender as estratégias dos agentes em adotar arranjos específicos para a realização das transações, como mecanismos redutores de incerteza. Este artigo buscou localizar falhas institucionais no sistema de crédito brasileiro investigando a evolução das instituições e as principais mudanças ocorridas no sistema. Verificou-se que, desde a criação do Sistema Nacional de Crédito Rural (SNCR), avanços institucionais foram realizados, entretanto, há problemas que geram fricções entre os agentes aumentando os custos da transação. O estudo permitiu evidenciar ainda que houve uma evolução nas formas contratuais como resposta a três desafios centrais: i) a retirada gradual do recurso controlado pelo governo; ii) a conseqüente entrada de empresas privadas no mercado de credito por meio do trade credit e iii) a necessidade de adaptar o contrato de crédito às incertezas do ambiente.
