Resumo: In view of the great conceptual difficulty, the article proposes to define more precisely the concept of terrorism in the light of national and international doctrine and legislation, in addition to critically analyzing the Brazilian incriminating model. It provides a critical analysis of the constitutional determination of criminalization, discussing the scope of such a commandment and its respective legal consequences. It argues that the legal-criminal good is a guideline and unbreakable limit in the development of any criminalization, outlining the essential elements for a legal classification of acts of terrorism in Brazil in full compliance with the fundamental principles of Criminal Law. Explores the logical-linguistic analysis of the constitutional criminalization order and the other elements of the constitutional-criminal norm. To this end, we start from a logical-deductive, dialectical and inductive-argumentative approach, analyzing the facts from a general perspective to a specific one.

Perfaz uma análise crítica acerca da determinação constitucional de criminalização, discutindo sobre o alcance de tal mandamento e suas respectivas consequências jurídicas. Argumenta ser o bem jurídico-penal diretriz e limite infranqueável no desenvolvimento de qualquer criminalização, delineando os elementos essenciais para uma tipificação legal dos atos de terrorismo no Brasil em plena conformidade com os princípios fundamentais do Direito Penal. Explora a análise lógico-linguística do mandado constitucional de criminalização e os demais elementos da normal constitucional-penal.
