35 YEARS OF THE 1988 CONSTITUTION AND ADVANCES IN SOCIAL RIGHTS: TOWARDS AN INTEGRATIVE PROTECTION OF HUMAN PERSONALITY?

Resumo: Since the promulgation of the Constitution of the Federative Republic of Brazil in 1988, 35 years have passed, and as time has passed, new constitutional amendments have been approved, altering and adapting constitutional protection to the current reality. It was no different with social rights, constitutional protection advanced and improved the rights provided for in art. 6th of the constitution. In this context, the present article has as its problematic the question: over the 35 years of the Federal Constitution, has the panorama of social rights advanced towards an integrative protection of human personality? Based on the research problem, the article's general objective was to analyze whether the advancement of social rights throughout these years of the Constitution can be considered as a step towards an integrative protection of human personality in the Brazilian legal system. And as specific objectives: a) analyze the advances made in the protection of fundamental social rights since the promulgation of the Constitution; b) verify whether there is an interdependent relationship between social rights and personality rights; c) investigate whether advances in social rights reflect an integrative protection of human  personality. To enable such analysis, a qualitative approach was used, the deductive research method and the methodological procedure based on the non-systematic literature review technique. As a result, it was possible to see that advances in social rights reflect an integrative protection of human personality.

Com os direitos sociais não foi diferente, a tutela constitucional avançou e aprimorou os direitos previstos no art. 6º da constituição. Nesse contexto, o presente artigo possuiu por problemática o questionamento: ao longo dos 35 anos de Constituição Federal, o panorama dos direitos sociais avançou para uma tutela integradora da personalidade humana? Pautando-se no problema de pesquisa, o artigo teve por objetivo geral analisar se o avanço dos direitos sociais ao longo desses anos de Constituição pode ser considerado como um caminhar rumo a uma tutela integradora da personalidade humana no ordenamento jurídico brasileiro. E como objetivos específicos: a) analisar sobre os avanços obtidos na tutela dos direitos fundamentais sociais desde a promulgação da Constituição; b) verificar se há uma relação de interdependência entre os direitos sociais e os direitos da personalidade; c) investigar se os avanços nos direitos sociais refletem em uma tutela integradora da personalidade humana. Para viabilizar tal análise, utilizou-se de uma abordagem qualitativa, do método dedutivo de pesquisa e do procedimento metodológico pautado na técnica de revisão não sistemática da literatura.
