Resumo: The present article has as its object the foundation of the legal system. The central problem is the dichotomy between the idea of transcendence, which for a long time was associated with the banner of jusnaturalism, and the idea of immanence, associated with juspositivism and other areas of scientific knowledge, such as, for example, biology and sociology. The thesis defended here is that the rhetoric of immanence is not a creation of the present day, but a re-reading or rediscovery of a similar idea already existing in ancient Greece.
