This work intends to present and study the memory of human rights from its violations, addressing the black trajectory from the period of slavery to the present, in order to show, from the Benjaminian conception, how to construct an official narrative that excludes blacks are a source of violence. The symbolic aspect of our constitution is defended, using the theoretical basis of Professor Marcelo Neves to demonstrate how, despite the broad guarantees of fundamental rights established in the 1988 Constitution, these do not materialize for a large part of the population, notably blacks, seeking thus showing, the hidden face of racism in Brazil, from the conception of Structural Racism by Silvio de Almeida. Finally, the work will seek to develop how the testimony literature, especially that of Conceição Evaristo in Becos da Memória, can contribute to rethink the issue of inequality, racism, and the violation of human dignity in Brazil, insofar as the role of a portion of the population that is often overlooked by the State is suggested, taking charge of bringing other versions that official history does not show and that cannot be achieved by dogmatic law
