A convenção sobre os direitos da pessoa com deficiência: a necessidade de adequação do ordenamento interno

The article dealt with the subject of the necessary adaptation in the Brazilian legal system, regarding the protective norms of persons with disabilities, especially in relation to the labor market and education, in order to comply with the International Convention on the Rights of Persons with Disabilities, which , in Brazil, has a constitutional amendment force, since it was deliberated in accordance with §3 of article 5 of the Brazilian Federal Constitution, presenting constitutional normative force. In this UN Convention, there is a prohibition of discrimination against persons with disabilities and the search for the promotion of their rights, in order to realize the principle of equality and to realize ways of equalizing opportunities in society, insofar as it emphasizes commitment of the Brazilian State to ensure the necessary support measures that prioritize the social development of the human being with disabilities. The adequacy of the Brazilian legal system is indispensable so that the primary objective of the document, which is to prohibit discrimination against persons with disabilities and to protect / promote the inherent and inalienable rights of these individuals, is carried out in a way that promotes respect for their intrinsic dignity, since the deficiency lies in society and not in the individual, as defended in the Convention.
