This paper aims to discuss the different problems of the Welfare State, always having as theoretical foundation the works and the meanings of Jürgen Habermas. The general objective was to define the paradigms of this State, the economic force as its predator and its aggression for a new capitalist model and for the political conservatism (neoliberalism). Their internal contradictions, however, are noted in the colonization of workers, in a policy of inclusion that does not listen to the voice or that does not have the participation of the excluded and a state bureaucracy used as a form of oppression. A way out put by Habermas to meet social solidarity could be found in a public space imbued with a democratic perspective. The justification is the moment of deep crisis through which the social state is going. The method is the dialectics before the overcoming of several paradigms of Rights until one reaches the participatory democracy - result presented by Habermas – as a principle of a just society.
