Resumo: : This paper states that it is only in the decision that the juridical norm is constituted. To approach this theme, we shall use ways from the ethno-methodology to hone law’s overloading as the main common ethical environment to controlling ethical fragmentation, as well as the decision and Judiciary’s overloading at modern state law; and, finally, reach the superior courts’ judicial activism crossroad and the weakening of state’s decisionism of everyday.
