Estado de coisas inconstitucional: uma análise da superlotação do sistema carcerário e a consequente violação de direitos fundamentais dos presos

Resumo: | The present study aims to analyze the overcrowding of the Brazilian prison system, how it violates the fundamental rights of prisoners and the characterization of this scenario as an unconstitutional state of affairs, in reference to the Colombian court theme, in addition to the current innovations of the superior courts on of the theme. In order to do so, it initially discusses the evolution of the concept of human dignity, a concept inherent to the human being and responsible for guiding and carrying with it a range of fundamental rights, in addition to unraveling this principle in the Federal Constitution of 1988 and the way in which it is applied, or not, in the Brazilian prison system. Then, it analyzes the current scenario of Brazilian prisons, which are overcrowded and without minimum conditions for serving the sentence by the convicts, as they lack in several sectors, such as infrastructure, health, education, in addition to highlighting several violations of constitutional and infraconstitutional laws, international conventions, through a torturous and inhumane attitude towards the detainees, creating a counterpoint between what should be applied and the distant reality. Finally, it investigates the institute of the Unconstitutional State of Things, used for the first time in the Colombian Court, by reporting a scenario in which successive and massive injuries to fundamental rights occur, due to omissions and actions of public authorities that are in disagreement. In addition, it performs an analysis of the application of this institute in the Brazilian prison system through ADPF nº 347, the measures and solutions adopted in the case, in addition to its effective application, whether it is occurring or not. Faced with this scenario, the higher courts seek jurisprudential solutions to remedy this chaotic situation. |

Para tanto, inicialmente discorre acerca da evolução do conceito da dignidade humana, conceito inerente ao ser humano e responsável por nortear e carregar consigo uma gama de direitos fundamentais, além de destrinchar sobre tal princípio na Constituição Federal de 1988 e o modo em que este é aplicado, ou não, no sistema carcerário brasileiro. Em seguida, analisa o cenário atual dos cárceres brasileiros, os quais encontram-se superlotados e sem condições mínimas de cumprimento de pena pelos apenados, pois carecem em diversos setores, como infraestrutura, saúde, educação, além de evidenciar diversas violações a normas constitucionais e infraconstitucionais, convenções internacionais, através de uma postura torturante e desumana com os detentos, realizando um contraponto entre o que deveria ser aplicado e a realidade distante. Por fim, investiga o instituto do Estado de Coisa Inconstitucional, utilizado pela primeira vez na Corte Colombiana, ao relatar um cenário em que ocorrem sucessivas e massivas lesões à direitos fundamentais, face omissões e ações dos poderes públicos que encontram-se em desacordo. Ademais, realiza uma análise da aplicação desse instituto no sistema carcerário brasileiro através da ADPF nº 347, as medidas e soluções adotadas ao caso, além da sua efetiva aplicação, se está ocorrendo ou não.
