The purpose of this paper is to analyze the laxity of the fundamental rights and democracy itself in situations of crisis. It is worthy mentioning that the crisis can be presented in various forms: sometimes political crisis, in some moments economic crisis, sometimes security crisis and even constitutional crisis. Since the end of the military dictatorship, when a new crisis appears some questions come up, for instance: Are our institutions solid? Is democracy at risk? Is it possible the retaking of the military dictatorship? Are the fundamental rights conquered at risk? This paper intends to analyze the treatment given by the Constitution to the fundamental rights during the periods of exception. Furthermore, it intends to verify how the State, while guardian of the fundamental rights, has acted in the moments of instability that are not understood as periods of exception because they are not arranged in the constitutional presuppositions but they bring insecurity and instability, like the case of the organized crime, parallel government and political crisis. It is a broad and fascinating theme of extreme importance in the individual’s life, whether isolated or inserted in the society.
